PlugVerse is committed to complying with United States copyright law, including the Digital Millennium Copyright Act (DMCA). We will respond to valid notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the PlugVerse platform, please follow the procedures below to notify us.

3. Filing a DMCA Takedown Notice

If you believe that content on PlugVerse infringes your copyright, you may submit a written DMCA takedown notice to our Designated Agent. Your notice must include the following information:

3.1 Required Information

1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
3. Identification of the allegedly infringing material and information reasonably sufficient to permit PlugVerse to locate the material (e.g., URL or specific description of where the content appears on the platform).
4. Your contact information, including your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Our Response to Valid Notices

Upon receiving a valid DMCA takedown notice, PlugVerse will:

1. Remove or disable access to the allegedly infringing material within 5 business days of receiving a complete, valid notice.
2. Notify the user who posted the content that the material has been removed or disabled due to a DMCA notice.
3. Provide the user with a copy of the takedown notice (with personal information redacted as appropriate) and information about filing a counter-notification.

5. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. Your counter-notification must include:

5.1 Required Information

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before it was removed.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if you are outside the United States, for any judicial district in which PlugVerse may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.

5.2 Counter-Notification Process

Upon receiving a valid counter-notification, PlugVerse will:

1. Promptly provide the original complainant with a copy of the counter-notification.
2. Inform the original complainant that the removed content will be restored in 10-14 business days unless we receive notice that they have filed a court action seeking to restrain the user from engaging in infringing activity.
3. Restore the removed content in 10-14 business days if no such court action notice is received.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, PlugVerse maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

PlugVerse may, at its sole discretion, limit, suspend, or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6.1 Strike System

PlugVerse uses a strike system for copyright violations:

• First Strike: Warning and content removal. User is notified and educated about copyright policies.
• Second Strike: Content removal and temporary account restriction. User may have reduced platform privileges for a period of time.
• Third Strike: Content removal and permanent account termination. Users who receive a third valid DMCA strike will have their account permanently suspended and will be prohibited from creating new accounts.

Strikes may be reviewed after 12 months of no violations or upon successful counter-notification. PlugVerse reserves the right to permanently terminate accounts that demonstrate a pattern of willful infringement, regardless of whether the three-strike threshold has been reached.

7. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Before filing a DMCA notice or counter-notification, please make sure that you are the actual rights holder (or authorized to act on behalf of the rights holder) and that you have a good faith belief that the use of the material is not authorized.

We recommend consulting with legal counsel before submitting a notice or counter-notification if you are unsure whether the material infringes your copyright.

8. Content Types and Copyright Considerations

8.1 Music and Audio

Artists uploading music to PlugVerse must ensure they own the copyright or have proper licenses for all audio content. This includes original compositions, cover songs, samples, and any background music.

8.2 Images and Videos

All images and videos uploaded must be owned by the user or properly licensed. This includes profile photos, promotional images, and performance videos.

8.3 Cover Songs and Licenses

Performing cover songs at venues typically requires the venue to have proper performance licenses (ASCAP, BMI, SESAC). Artists should not upload recordings of cover songs without mechanical licenses.
